1. Acceptance of Terms

By accessing or using CasaViva360 (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

2. Definitions

• Platform — the CasaViva360 website and mobile apps.
• User — any individual who accesses the Platform.
• Seller/Agent — a User who lists property for sale or rent.
• Buyer/Renter — a User who browses or enquires about listings.

3. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use the Service.

4. Accounts

• You are responsible for maintaining the confidentiality of your credentials.
• You must provide accurate and current information.
• One account per person. Sharing accounts is prohibited.
• We may suspend or terminate accounts that violate these Terms.

5. Listings & Content

• You are solely responsible for the accuracy of your listings and content.
• You must have the legal right to list the property.
• Prohibited content includes misleading information, fraudulent listings, and content that infringes third-party rights.
• We may remove listings that violate these Terms or applicable law.
• CRM-synced listings remain the responsibility of the listing agent.

6. Verification

Verification is optional. Verified status indicates we have reviewed submitted documents but does not guarantee the identity, legitimacy, or good faith of a User. We are not liable for interactions with verified Users.

7. Subscriptions & Fees

• Paid plans (e.g. Broker Agency) are billed via Stripe on a recurring basis.
• Promotional trial periods (including the 6-month free trial) are offered at our discretion and may end early for accounts that violate these Terms.
• Fees are non-refundable except where required by law.
• You may cancel at any time; access continues until the end of the billing period.

8. Enquiries & Communications

The Platform facilitates contact between Users. We are not a party to any transaction between buyers, renters, sellers, and agents. We are not an estate agent and do not represent any party in negotiations.

9. Prohibited Conduct

• Using the Service for any unlawful purpose.
• Scraping, copying, or redistributing listings or data without permission.
• Uploading malware or attempting to disrupt the Service.
• Impersonating another person or entity.
• Circumventing the Platform to avoid fees.

10. Intellectual Property

The Platform, its design, branding, and software are owned by CasaViva360. User-generated content remains the property of the User, who grants us a license to display it on the Platform and syndicated feeds.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy of listings, the availability of the Service, or the outcome of any transaction. Property data, market reports, and AI-generated content are for informational purposes only.

12. Limitation of Liability

To the maximum extent permitted by law, CasaViva360 shall not be liable for indirect, incidental, or consequential damages, or for any loss arising from transactions between Users. Our total liability is limited to the fees paid by you in the preceding 12 months.

13. Governing Law

These Terms are governed by Spanish law. Disputes shall be resolved in the courts of Madrid, Spain, without prejudice to your rights as a consumer.

14. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
